Medical care to underage patients at our facilities

In response to the numerous enquiries concerning the principles of providing medical care to underage patients at our facilities, we would like to provide you with the following information. The said principles are governed by the Act on the Patients' Rights and Patients' Rights Ombudsman, as well as the Act on the Physician's and Dentist's Profession. Please provide this information to the parents of our underage Patients - the issues addressed in this letter concern the safety of their charges.

Patients below the age of 18 may take advantage of the offered medical consultation, blood sample taking, diagnostics and rehabilitation services solely in the presence of a statutory representative or a de facto guardian (e.g. a grandmother). If the child is under the care of a de facto guardian, the said guardian is obligated to present a written authorisation from the statutory representative.

Please note, that according to the Family and Guardianship Code, specifically Article 92, Article 98 (1) and Article 95 (1), the parents are obligated to accompany a child under the age of 18 at medical consultations as well as examinations and tests. In emergency and exceptional cases, patients above the age of 16 but below the age of 18 may have a medical consultation without the presence of a statutory representative or de facto guardian, yet solely with a non-procedure specialist. The condition for providing this service is holding a written authorisation from the statutory representative. However, even with the authorisation being presented, the scope of services we may provide to underage Patients in the absence of a statutory representative does not include diagnostic examinations or any procedures with the exception of life-saving ones.

Irrespective of the child's age, the presence of a statutory representative is necessary in the case of diagnostic services requiring the administration of contrast agents.

The authorisation is of one-off nature, i.e. it is admissible for one case only - a single visit at the LUX MED Group Medical Centre - and applies to one guardian. The model form of the authorisation is available here.

Please note that both the statutory representative and the de facto guardian accompanying the child are required to present their ID document during the visit.

The abovementioned legal provisions represent care for the safety of our young Patients and their parents. We are not only obligated to adhere to them but we are also deeply convinced of their soundness. Therefore, we spare no effort in making the compliance with the regulations in force not to hinder the satisfactory use of our services.
